Employers have a contractual
obligation to pay the agreed wages etc. Disputes often arise following the
resignation of an employee or dismissal in acrimonious circumstances.
Complications can arise when expenses are not paid as in many cases the
receipts have already been handed over to the employer and commissions can be
disputed or "clawed back" on the pretext that the qualifying business has been
withdrawn
The Claimant may have some difficulty in obtaining a witness
to events - the potential witnesses will probably put their employment first.
However, good documentation can support such claims as can a diary of visits
made by the Claimant and a list of successful business resulting from each
visit. The Claimant's witness statement is very important in support
of this type of claim and should be supported with all relevant documents.
Particular attention should be paid to dates and times and comments by the
employer should be recorded verbatim. If you are now ready to commence
proceedings please go to our Submit Form and
complete the required details. |
